GRATEFUL DRIFT – LIABILITY WAIVER & PARTICIPANT AGREEMENT

1. Assumption of Risk

I understand that boating, pontoon operation, and water activities involve inherent risks including, but not limited to:

• Slips, falls, collisions, or capsizing

• Weather conditions

• Equipment failure

• Injuries resulting from passenger conduct

• Risks associated with operating or riding on a motorized vessel

I voluntarily assume all risks, both known and unknown, associated with participation in this rental.

2. Liability Release

In consideration of being permitted to rent and/or ride on a pontoon operated under Grateful Drift, I hereby release, waive, and discharge:Grateful Drift, Grateful Happening LLC, its owners, employees, contractors, and affiliates

from any and all liability, claims, demands, actions, or causes of action arising out of or related to any loss, damage, injury, or death while participating in this rental, whether caused by negligence or otherwise.

3. Rental Requirements

By signing this waiver, I confirm the following:

• I am 21 years or older to rent.

• Any operator of the vessel is 21+ with a valid driver’s license.

• I (or the designated operator) have prior saltwater boating experience.

• I will operate the vessel safely and responsibly.

• I understand no smoking or vaping is allowed on the vessel.

• I understand no alcohol consumption is allowed on the vessel.

• Maximum capacity is 10 passengers.

• All passengers must remain seated while the boat is in motion.

• Children under 8 must wear a life jacket at all times, per Alabama law.

4. Damage Responsibility

I understand that I am fully responsible for:

• Any damage caused to the pontoon, motor, propeller, interior, or equipment

• Excessive cleaning fees (sand, spills, trash, etc.)

• Loss or damage to life vests, anchors, or safety equipment

I authorize Grateful Drift to charge my card for any damages or excessive cleaning deemed necessary.

5. Weather Policy

I understand that Grateful Drift determines weather safety. If conditions are unsafe (lightning, high winds, small craft advisories), Grateful Drift may cancel or reschedule my rental.Refunds or rescheduling will follow the posted Booking Policy.

I agree to listen to and follow the safety briefing provided before departure, including:

• Operation of the vessel

• Emergency procedures

• No-wake zones

• Navigation boundaries

• Return instructions and docking safety

8. Indemnification

I agree to indemnify and hold harmless Grateful Drift and its owners from any claims brought by guests, family members, or others in my group.

9. Photo & Media Release (Optional)

I give permission for Grateful Drift to use photos or videos taken during my rental for promotional purposes.

10. Acknowledgment & Signature

By signing below, I acknowledge that I have read, understood, and agree to all the terms of this Liability Waiver & Participant Agreement. I also confirm that all information provided is truthful and accurate.
